Dear Mr. Raiszadeh: In your letter dated June 25, 2012, you requested a tariff classification ruling. You provided illustrative material of slipper socks without an applied sole. No sample was provided to U. S. Customs and Border Protection. Style 1 is composed of 98% polyester, and 2% spandex knit fabric. Style 2 is composed of 50% cotton and 50% polyester. The socks feature a hemmed rib-knit elasticized top and non-skid rubberized dots on the bottom of the socks. Due to the fact that Style 2 is constructed of a 50/50 blend of fibers, it is classified using Harmonized Tariff Schedule of the United States (HTSUS) Section XI Subheading Note 2(A). The socks will be classified as if it consisted wholly of that one textile material which is covered by the heading that occurs last in numerical order among those, which equally merit consideration. Even a slight change in the fiber content may result in a change of classification. The socks may be subject to Customs laboratory analysis at the time of importation, and if the fabric is other than a 50/50 blend it may be reclassified by Customs at that time. The applicable subheading for Styles 1 and 2 slipper sock will be 6115.96.9020,HTSUS, which provides for "Panty hose, tights, stockings, socks and other hosiery, including stockings for varicose veins, and footwear without applied soles, knitted or crocheted: Other: Of synthetic fibers: Other: Other…Other." The rate of duty will be 14.7% ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
