N222435 July 11, 2012 CLA-2-73:OT:RR:NC:N4:428 CATEGORY: Classification TARIFF NO.: 7310.29.0050 Mr. Erik O’Brien 2121 Paulding Avenue, Apartment 6T Bronx, NY 10462 RE: The tariff classification of a steel canister from Japan. Dear Mr. O’Brien: In your letter dated June 15, 2012, you requested a tariff classification ruling. The merchandise under consideration is a canister which measures approximately 2.6 inches high by 2.3 inches in diameter and features a twist-off lid. A sample of the canister was submitted with your ruling request and will be returned to you. From the information you provided, this canister will be imported empty; after importation it will be filled with loose tea leaves and sold. In a telephone conversation on June 27, 2012, you stated that the canister is made of steel. The applicable subheading for the steel canister will be 7310.29.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Tanks, casks, drums, cans, boxes and similar containers, for any material (other than compressed or liquefied gas), of iron or steel, of a capacity not exceeding 300 liters, whether or not lined or heat insulated, but not fitted with mechanical or thermal equipment: Of a capacity of less than 50 liters: Other: Other.” The general rate of duty will be Free.
