N221068 July 10, 2012 CLA-2-96:OT:RR:NC:N4:422 CATEGORY: Classification TARIFF NO.: 9609.10.0000 Ms. Joann Mosqueda JA-RU, Inc. 4030 Phillips Highway Jacksonville, FL 32207 RE: The tariff classification of an oversized pencil from China Dear Ms. Mosqueda: In your letter dated June 7, 2012, you requested a tariff classification ruling. The submitted sample is identified as a Big Pencil. This item is a functional sharpened pencil that has a writing core which is encased in a rigid green wood sheath with an octagonal shape. The end that is opposite the writing end has a metal ferrule and a cylindrical eraser. The pencil measures approximately 14¾” long and 1¼” in diameter at the eraser end. The applicable subheading for the Big Pencil will be 9609.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pencils…with leads encased in a rigid sheath. The rate of duty will be 14 cents per gross plus 4.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
