Pinzer Quality Customs Broker 4464 South Whitnall Avenue Saint Francis, WI 53235 RE: The tariff classification of a novelty tote bag from China Dear Ms. Pinzer: In your letter, which was received on June 7, 2012, you requested a tariff classification ruling on behalf of your client, Solway Reivers, LLC. Your sample will be returned to you. The sample was submitted without a style number. The item is a tote bag constructed with an outer surface of nylon textile material. The front exterior has reflective overlays depicting ghosts, bats, and a scull. The bag has an open top without a closure, an unlined storage compartment, and two carrying straps. The bag is designed for and capable of prolonged use. The bag is designed to provide storage, organization, protection and portability for food and other personal effects during travel. It measures approximately 8” (W) x 6” (H) x 8” (D). The applicable subheading for the tote bag will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports, and similar bags, with outer surface of man-made textile materials. The rate of duty will be 17.6% ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
