N207726 March 26, 2012 CLA-2-42:OT:RR:NC:N4:441 CATEGORY: Classification TARIFF NO.: 4202.92.3005 Ralph Natale American Shipping Company, Inc. 250 Moonachie Road Moonachie, NJ 07074 RE: The tariff classification of a tote bag from China Dear Mr. Natale: In your letter dated March 2, 2012, you requested a tariff classification ruling on behalf of your client, Keenpac North America, Ltd. A style number was not provided for the sample submitted, which is a tote bag. Our examination of the bag indicates that the bag is constructed with an outer surface of twisted or rolled paper strips which are considered to be paper yarns for tariff purposes. This construction is a textile material. The tote bag is designed to provide storage, organization, protection and portability to clothing and other personal effects during travel. The interior of the bag is textile-lined and has a zippered pocket on the back wall. It has two shoulder straps, a nylon zipper closure at the top, and measures approximately 15” (W) x 11.5” (H) x 4” (D). The applicable subheading for the tote bag will be 4202.92.3005, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, other, of paper yarn. The rate of duty will be 17.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
