The subject product, Desloratadine, imported in 5mg tablet form is a medicinal preparation containing Desloratadine, a tricyclic antihistamine, which has a selective and peripheral H1-antagonist action, as the active ingredient. It is indicated for the relief of seasonal allergy symptoms and allergic nasal conditions (rhinitis) such as runny nose, sneezing, and itching eyes. The applicable subheading for the Desloratadine will be 3004.90.9180, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments ... consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses ... or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the eyes, ears or respiratory system: Other: Antihistamines.” The rate of duty will be free.
