Burr Blvd. - Suite 10 Teaneck, New Jersey 07666 RE: The tariff classification of WATERSOL NP-5000 polyester resin in aqueous solution from Japan. Dear Mr. Sekiguchi: In your letter dated November 16, 2011 you requested a tariff classification. You provided MSDS sheets for our review. WATERSOL NP-5000 is described as a polyester resin dissolved in water. The product will be imported in liquid form for use as an additive in automotive paint. The applicable subheading for WATERSOL NP-5000 polyester resin in aqueous solution will be 3907.99.0150, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Other polyesters: Other: Other, in primary forms. The rate of duty will be 6.5% ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U. S. Environmental Protection Agency.
