The tariff classification of pajama bags from China

Box 965 Shelburne, VT 05482 RE: The tariff classification of pajama bags from China Dear Mr. Burns: In your letter dated October 20, 2011, you requested a tariff classification ruling. You submitted photographs of two non-woven polypropylene bags that will be used as packaging for men’s and women’s pajamas you market as “Pajamagrams.” This ruling will classify the bags only, when they are imported separately from the pajamas. The bag for men’s pajamas is style #PJ Packaging Men’s. The bag has a flat circular bottom with a diameter of 14”; from the base, two panels are sewn together for a height of 14”. The bag is pulled closed along the top panel with a braided draw cord held with a plastic spring toggle. When drawn closed the length of cord is secured to a tab with a snap sewn to the base of the bag for added security. The bag for women’s pajamas is style #PJ Packaging Women’s. This bag has a flat circular bottom and the base measures 11-1/2” in diameter. Two panels are sewn together for a height of 16”. The bag is pulled closed by pulling two narrow fabric loops through a casing sewn around the outside of the top panel, then making a knot or bow to keep the top closed. The applicable subheading for men’s and women’s “Pajamagram” pajama bags, when imported separately, will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change.
