N172496 July 14, 2011 CLA-2-14:OT:RR:NC:2:228 CATEGORY: Classification TARIFF NO.: 1404.90.9090 Mr. Brian Kavanaugh Deringer Logistics Consulting Group 173 West Service Road Champlain, NY 12919 RE: The tariff classification of Mo’Koko coco substrate from the Netherlands Dear Mr. Kavanaugh: In your letter dated June 20, 2011, on behalf of Brite-Lite Group, Quebec, Canada, you requested a tariff classification ruling. A description of the manufacturing process, advertising literature and a sample were provided with your letter. The sample was examined and disposed of. Mo’Koko coco substrate is a granular, coffee-colored material resembling peat moss, used as a plant growing medium or soil conditioner. The product is made from coconut husks by shredding, chopping and heat-treating, and will be imported in 50-liter bags or 4.5-kg compressed blocks. The applicable subheading for the coco substrate will be 1404.90.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for vegetable products not elsewhere specified or included … other … other … other. The duty rate will be free. Duty rates are provided for your convenience and are subject to change. The importation of this merchandise may be subject to regulations or restrictions administered by the U.S. Department of Agriculture, Animal and Plant Health Division (APHIS) and/or the U.S. Food and Drug Administration. This merchandise is subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA).
