Hackett Accessories Marketing, Inc. 800 Farroll Road Grover Beach, CA 93433 RE: The tariff classification of a tire marker from China Dear Mr. Hackett: In your letter dated June 17, 2011, you requested a tariff classification ruling. The submitted illustration depicts an item that is identified as a Tire Marker, item# 111-A. This item is constructed in stick form in the manner of a crayon, is comprised of 100% white paraffin wax and does not have a sheath or protective band of any kind. It is designed to be used to touch up white walls and tire lettering for pneumatic tires. It measures approximately 4½”L x ¼”W x ½”H. The tire marker weighs .7 oz and is packaged for retail sale before importation. You have suggested that this item is correctly classified in subheading 9609.90.8000 and we agree with your suggestion. The applicable subheading for item# 111-A will be 9609.90.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for …crayons…: other: other. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
