Hampton, Jr. & Co., Inc. 161-15 Rockaway Boulevard Jamaica, NY 11434 RE: The tariff classification of a paper yarn basket from China Dear Mr. Shoule: In your letter dated March 11, 2011, you requested a tariff classification ruling on behalf of your client, Sunset Bay d/b/a Andrea Baskets, of Bohemia, N.Y. You submitted a sample of a paper yarn basket measuring 9” long, 9” wide and 7” deep. The basket has a metal frame. Rolled paper strips create the paper yarns, thirteen of which are glued together to form a buldoc, a narrow fabric of parallel yarns without any crossing yarns, joined by an adhesive. The buldocs are then woven through the metal wires that form the basket. The paper yarns made of rolled paper are considered a textile for tariff purposes. Similarly, the buldocs are considered narrow textile fabrics. The metal wire frame encompasses the top and bottom rims of the basket, with one wire in the center across the bottom. The wire frame by itself does not form a basket that would be capable of holding items. The applicable subheading for the paper yarn basket will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. You have also submitted a picture of rectangular baskets, nested in sets of three. You say these baskets are also wire framed and woven through with paper yarns. Each basket has a fitted polyester or cotton textile lining, which covers the inside of the basket, and folds over the rim to the outside of the basket. Your inquiry does not provide enough information for us to give a classification ruling on these baskets. Your request for a classification ruling should include the size of each basket and their use. When this information is available, you may wish to consider resubmission of your request. If you decide to resubmit your request, please include all of the material that we have returned to you. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
