Dear Ms. Flaig: In your letter dated October 8, 2010, you requested a tariff classification ruling. A description and photos were included with your request. Five items were included in your request, all of which are solely designed to be installed in the cargo bay of a civil aircraft. Part 7713525-28, is a side cargo rail assembly. When installed in the aircraft these mechanical devices both guide cargo during loading and unloading, and restrain the cargo from movement in flight by the use of spring loaded flippers. Part 7713525-28 is assembled in the USA. Part A805100-11 is a splitter R guide which is attached to the aircraft cargo bay floor and when in use, is upright from the floor to assist in guiding the cargo during loading and unloading. Part A805100-11 is assembled in India. Part 77F1000-1 is a pallet lock assembly which is attached to the cargo bay floor and extended upward after loading to restrain cargo from movement. Part 77F1000-1 is assembled in the USA. Part A8738000-046 is an equipped roller track which is installed to add structural support to the aircraft as well as to act as a base for the installation of other parts mentioned in this ruling. Part A8738000-046 is assembled in the USA. Part 7877120-1 is a floor panel specifically designed for the aircraft to allow a walking surface for workers in the cargo bay during loading and unloading operations. Part 7877120-1 is manufactured in the USA. The applicable subheading for the five aircraft cargo bay components will be 8803.30.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for parts of goods of heading…8802: other parts of airplanes…, for use in civil aircraft: other. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
