Gerlach & Co., Inc. 290 Central Avenue, Suite 105 Lawrence, NY 11559 RE: The tariff classification of decorative storage bins from China Dear Mr. Chand: In your letter dated Sept. 1, 2010, you requested a tariff classification ruling on behalf of your client, Creative Bath Products, of Islip, N.Y. You submitted samples of two decorative storage bins. They are general purpose storage bins that can be used on counters, desks, or shelves, or on the floor. The first sample is identified as Medium Storage Basket (Totally Totes). It is constructed of woven fabric (85% polyester/15% cotton) over a chipboard support and measures 12” x 16” x 9” deep. It has cutout metal handles. The second sample, Large Brown Storage Basket (Flora) has an exterior surface that is made of a knit/woven fabric that is 85% paper yarns and 15% polyester yarns; the inner surface is 100% polyester woven fabric. It measures 14” x 18” x 10” deep. It has cutout metal handles. The applicable subheading for the decorative storage bins will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
