Dear Ms. Merari: In your letter dated May 21, 2010, you requested a tariff classification ruling. You submitted printed product data, and you also provided additional information via telephone and email. The product in question is identified as item 60009, “Retama Brand Goat’s Milk Cheese, Plain, 1-kilo.” It is said to be an off-white, natural-rind cheese, aged three to six months, supplied in 1-kilogram wheels. The ingredients are: pasteurized goat’s milk, salt, milk ferments, rennet, calcium chloride and lysozyme. The cheese is said to have a moisture content of 36-40 percent and a fat content of 34-37 percent. The applicable subheading for the #60009 “Retama Brand Goat’s Milk Cheese, Plain, 1 kilo” will be 0406.90.9900, Harmonized Tariff Schedule of the United States (HTSUS), which provides for cheese and curd: other cheese: other cheeses, and substitutes for cheese, including mixtures of the above: other, including mixtures of the above (excluding goods containing mixtures of subheadings 0406.90.61 or 0406.90.63): other: other: other. The rate of duty will be 8.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
