Dear Ms. Tsiavos: In your letter dated April 19, 2010, you requested a tariff classification ruling. The Executioner Costume Set consists of a robe, gloves, hood, collar and belt. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the flimsy black robe imparts the essential character of the set. The robe is constructed of woven 100% polyester fabric. The garment has a hook and loop tab closure, loose, visible overlock stitched seams, and loose, visible overlock stitched and/or visible raw edges at the neck, arms, and hem. The costume set will be imported in the following styles: Styles 131351 and 131351H, Toddler Sized Executioner Costume Set; styles 131352 and 131352H Child Sized Executioner Costume Set; styles 131353 and 131353H, Teen Sized Executioner Costume Set; styles 131354 and 131354H, Adult Executioner Costume Set; and styles 131355 and 131355H, Plus Sized Executioner Costume Set. Styles identified with an "H" are packaged on a hanger with a color insert. The applicable subheading for the Executioner Costume Set will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change.
