Dear Ms. Tsiavos: In your letter dated April 19, 2010, you requested a tariff classification ruling. The Zombie Monk Costume Set consists of a robe, hood, and stole. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the brown robe imparts the essential character of the set. The robe is constructed of linen and rayon woven fabric. The garment has a well made neck, a string tie closure, loose, visible overlock stitched seams, and loose, visible overlock stitched and/or visible raw edges at the arms, and hem. The costume set will be imported in the following styles: Styles 130041 and 130041H, Toddler Sized Zombie Monk Costume Set; styles 130042 and 130042H Child Sized Zombie Monk Costume Set; styles 130043 and 130043H, Teen Sized Zombie Monk Costume Set; styles 130044 and 130044H, Adult Zombie Monk Costume Set; and styles 130045 and 130045H, Plus Sized Zombie Monk Costume Set. Styles identified with an "H" are packaged on a hanger with a color insert. The applicable subheading for the Zombie Monk Costume Set will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change.
