N096936 March 26, 2010 CLA-2-63:RR:NC:N3:349 CATEGORY: Classification TARIFF NO.: 6301.40.0010 Mr. Thomas Filbeck Phoenix International Freight Services, Ltd. 10801 North Pomona Avenue Kansas City, MO 64153-1205 RE: The tariff classification of a blanket from India Dear Mr. Filbeck: In your letter dated March 4, 2010 you requested a classification ruling. The submitted sample is a blanket. The blanket is stated to be made from 55 percent polyester and 45 percent wool fabric. The fabric is napped on both sides. The blanket measures approximately 64 x 84 inches. All of the edges are finished with an overlock stitch. There are several rows of yarn dyed stripes near each end. The applicable subheading for the blanket will be 6301.40.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for blankets and traveling rugs, blankets (other than electric blankets) and traveling rugs, of synthetic fibers, woven. The duty rate will be 8.5 percent ad valorem. The submitted sample is not marked with its country of origin. Section 134.11 of the Customs Regulations (19 C.F.R. 134.11) provides in part: Unless excepted by law...every article of foreign origin (or its container) imported into the U.S. shall be marked in a conspicuous place as legibly, indelibly, and permanently as the nature of the article (or container) will permit, in such a manner as to indicate to an ultimate purchaser in the U.S. the English name of the country of origin of the article, at the time of importation into the Customs territory of the U.S. Additionally, please note that separate Federal Trade Commission marking requirements exist regarding country of origin, fiber content, and other information that must appear on many textile items.
