Dear Mr. Sullivan: In your letter dated February 17, 2010 you requested a tariff classification ruling. Descriptive literature and an illustration were submitted. The item you plan to import is identified as the “Napoleon UD405RSBPSS-3 Propane/Stainless Steel Ultra Chef Closed Cabinet Cart-Style Grill with Side Burner.” This barbeque grill measures 36 X 30 X 24 inches and weighs approximately 152 pounds. The grill is fueled by propane gas and features three stainless steel bottom burners, a 10,500 BTU side burner, a 14,000 BTU stainless steel infrared rotisserie burner, a 680 square inch cooking area and electronic ignition. It also includes fold down stainless steel side shelves, an enclosed cabinet with a curved stainless steel door, a stainless steel lid insert and a temperature gauge with ACCU-PROBE. The applicable subheading for the gas barbeque grill will be 7321.11.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other cooking appliances and plate warmers for gas fuel or for both gas and other fuels. The general rate of duty is free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
