Dear Ms. Collins: In your letter dated January 15, 2010 you requested a tariff classification ruling. The sample will be returned to you. The submitted sample called a “Snood” is constructed of knit 70 percent rayon, 15 percent nylon, 10 percent silk and 5 percent cashmere fabric. The item is cylinder shaped, open at the top and bottom, and measures approximately 15 inches long and 20 inches wide when laying flat. The item has one lengthwise seam and rib knit edges at the top and bottom. The item will be advertised for wearing on the head and when worn resembles a loose fitting hood. The applicable subheading for the “Snood” will be will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Hats or other headgear, knitted or crocheted, or made from lace, felt or other textile fabrics, in the piece (but not in strips)…Other: Other: Of man-made fibers: Knitted or crocheted or made up of from knitted or crocheted fabric: Not in part of braid, Other: Other: Other.” The rate of duty will be 20 cents per kilogram plus 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
