N082515 November 20, 2009 CLA-2-84:OT:RR:NC:N1:120 CATEGORY: Classification TARIFF NO.: 8471.50.0150 Ms. Jolene Lim Schenker of Canada LTD 6555 Northwest Drive Mississauga, Ontario L4V1K2 Canada RE: The tariff classification of an HCN Navigator from China Dear Ms. Lim: In your letter dated October 30, 2009, on behalf of The Hotel Communication Network Incorporated, you requested a tariff classification ruling. The merchandise under consideration is referred to as the HCN Navigator which will be used in hotel rooms to provide access to the internet as well as access to hotel services and information directories. The HCN Navigator comprises a flat base stand with a thick neck used to hold a liquid crystal display (LCD) touch display. It has a VESA hinge and four screws to attach the LCD to the stand. The LCD screen is sold and imported separately. The HCN Navigator houses a central processing unit (CPU), basic input output system (BIOS) and a motherboard located in the base of its stand. The HCN Navigator base will have a D-Link USB 802.11N, model DWA-160 wireless network card installed to its motherboard upon importation for LAN radio connectivity. The motherboard consists of an Intel Atom N270 1.6 GHz processor which is compatible with Windows XP and Windows Vista. The hardware uses an AMI, plug and play BIOS with a single 8Mbit SPI flash, DMI, plug and play. The system memory supports one 200-pin unbuffered DDR2 SO-DIMM sockets for a maximum memory of 2GB DDR2 SDRAMs. The memory module can come in sizes of 128MB, 256MB, 512MB and 2GB. A telephone and keyboard can be attached via USB and is imported separately. The HCN Navigator has fully integrated wireless mesh communications to be a receiver and transmitter of high-bandwidth communications. The HCN Navigator is an Automated Data Processing (ADP) machine that meets the requirements of Note 5(A) to Chapter 84, Harmonized Tariff Schedule of the United States (HTSUS). The applicable subheading for the HCN Navigator will be 8471.50.0150, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Processing units other than those of subheading 8471.41 or 8471.49, whether or not containing in the same housing one or two of the following types of unit: storage units, input units, output units: other....” The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
