Inwood, NY 11096 RE: The tariff classification of a gas piston from China or Taiwan Dear Mr. McGeary: In your letter dated July 27, 2009, you requested a tariff classification ruling on behalf of Kason Industries Inc. The merchandise under consideration is a gas piston made of steel, part number 1094-316. It is designed to be used in a “1094 Sure Close Hydraulic Door Closer,” which controls the closing speed and snubbing of doors used on commercial refrigeration units. The piston functions to control the movement of the hinged roller against the hook plate. The applicable subheading for the gas piston will be 8302.49.6035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for base metal mountings, fittings and similar articles suitable for furniture, doors, staircases, windows, blinds, coachwork, saddlery, trunks, chests, caskets or the like…other mountings, fittings and similar articles, and parts thereof, other, other, of iron or steel, of aluminum or of zinc, pneumatic cylinders for lifting, lowering, dampening or counterbalancing. The rate of duty will be 5.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
