Dear Ms. Torrini: In your letter dated June 23, 2009, you requested a tariff classification ruling. A sample was provided with your letter of Item #71982, described as a shiny gold ornament pick. The sample pick consists of a gold painted plastic ball attached to a wooden stick for an overall length of 7 inches. The pick can be used to decorate flower arrangements. The pick is available in various colors. Item #71977 is described as a sparkle lime green ornament pick and Item #71983 is described as a gold sparkle ornament pick. Item #71984, described as a cream/gold sparkle pick, consists of plastic stems painted cream and gold attached by florist tape to a plastic coated wire stem. The applicable subheading for the single ball ornament sticks, Items 71982, 71977 and 71983, will be 3926.40.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics…statuettes and other ornamental articles. The rate of duty will be 5.3 percent ad valorem. Your inquiry does not provide enough information for us to give a classification ruling on Item #71984, the cream/gold sparkle pick made of multiple stems. Your request for a classification ruling should include a sample. When this information is available, you may wish to consider resubmission of your request.
