N063780 June 12, 2009 CLA-2-72:OT:RR:NC:1:117 CATEGORY: Classification TARIFF NO.: 7217.90.1000 Ms. Elham Jawady 7325 Imperial Drive Waco, TX 76712 RE: The tariff classification of plastic coated wire from China. Dear Ms. Jawady: In your letter dated June 1, 2009 you requested a tariff classification ruling. A representative sample was submitted with your request and will be retained by this office. The product to be imported is nonalloy steel wire which is coated with a clear plastic. Imported in coil form, this wire will be cut to length and used to tie down bed risers. You suggest classification of the wire under subheading 7326.20.0070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of iron or steel, articles of iron or steel wire, other. However, plastic coated wire of nonalloy steel is specifically provided for in heading 7217, HTSUS. The applicable subheading for the plastic coated wire will be 7217.90.1000, HTSUS, which provides for wire of iron or nonalloy steel, other, coated with plastics. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
