Northwest Highway Suite 500 Grapevine, TX 76051 RE: The tariff classification of a waist apron from China Dear Mr. Darter: In your letter dated May 18, 2009, you requested a tariff classification ruling on behalf of your client, Selecta Corporation, LLC. The submitted sample is a half apron constructed of 65% polyester and 35% cotton woven twill fabric that measures approximately 29” in width and 14” in length. The apron is worn at the waist and hangs to the top of the thigh area. There is no coverage of the upper body. There is matching capping along all edges of the apron and the capping along the top of the apron extends to form two ties which allow the apron to be tied around the waist. It has one large pocket which extends along the bottom of the apron and has a second pocket sewn just to the left side of the first pocket. The words CVS/pharmacy are embroidered on the larger pocket. The applicable subheading for the waist apron will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
