Dear Mr. Rizner: In your letter dated May 7, 2009, you requested a tariff classification ruling on behalf of Holloway Sportswear. As requested, your sample will be returned. Style 9560 “Ultimatum” is a pair of men’s pants constructed from 100% polyester, woven twill fabric. Style 9560 has a flat waistband with six belt loops; a zippered fly front opening with a button closure at the waistband; two side seam pockets; two rear welt pockets with button closures; and overlock stitching on the unfinished legs. Style 9560 will be imported in Men’s sizes 28-50. The applicable subheading for Style 9560 will be 6203.43.4010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s and boys’… trousers, . . . and shorts (other than swimwear): of synthetic fibers: other: other: other: other: trousers: men’s. The rate of duty is 27.9 % ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
