The submitted sample, style RA18171, is a woman’s romper constructed from 92 percent rayon and 8 percent nylon knit fabric. The garment extends from the shoulders to the upper thigh. The garment features a U shaped neckline, short self start sleeves, a three button crotch closure and self start leg openings. You ask whether this garment would be classified as a sweater or bodysuit. The garment is not classified as a sweater because it envelops the legs. The heavy knit construction precludes it from classification as a bodysuit. Bodysuits are finely knit. Your sample is being returned as requested. The applicable subheading will be 6114.30.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted, of man-made fibers, other, sunsuits, washsuits, one-piece playsuits and similar apparel, women’s or girls’. The duty rate will be 14.9% ad valorem. Duty rates are provided for your convenience and are subject to change.
