Dear Mr. Garcia: In your letter dated March 27, 2009, you requested a tariff classification ruling on behalf of your client, SMK Electronics Corporation. The merchandise under consideration are two television (TV) control panels identified as the Sony Control Panel APT2000-9211E and the Sony Control Panel APT200-9221C. A representative sample was submitted with your ruling request. The representative sample control panel consists of a printed circuit board (PCB) with seven momentary contact push-button switches and a three-pin connector mounted onto a plastic panel which measures approximately 7½ inches high by 1½ inches wide. These control panels are designed for operating a color TV with a liquid crystal display (LCD). The plastic panel is labeled with the various control functions for each switch including on/off power, channel up/down selector, volume up/down control, video input selection, and menu selection for TV settings. The plastic panels incorporate six connecting tabs for fastening into the side of the TV housing. The applicable subheading for the Sony Control Panels APT2000-9211E and APT200-9221C will be 8537.10.9070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Boards, panels, consoles, desks, cabinets and other bases, equipped with two or more apparatus of heading 8535 or 8536, for electric control or the distribution of electricity…: For a voltage not exceeding 1,000 V: Other: Other: Other.” The general rate of duty will be 2.7% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
