Co.11F/6, No.2, Jian-Ba Road, Chung-Ho Taipei, Taiwan RE: The tariff classification of item # B-0098-05, Boy Vampire Cape, from China Dear Ms. Lee: In your letter dated February 27, 2009, on behalf of Sears Holdings Global Sourcing Ltd., you requested a tariff classification ruling. Item # B-0098-05, Boy Vampire Cape, is a flimsy textile costume comprised of a cape. Although the cape has a well-made neck, the cape is overwhelmingly flimsy, with loose, visible overlock stitched interior seams, a string tie closure, and visible overlock stitched and/or raw edges. The applicable subheading for item # B-0098-05, Boy Vampire Cape, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change.
