Wierbicki Tompkins & Davidson, LLP 5 Hanover Square, 15th Floor New York, NY 10004 RE: The tariff classification of two pillowcases from India Dear Ms. Wierbicki: In your letter dated February 18, 2009 you requested a classification ruling on behalf of Divatex Home Fashions, Inc. The submitted samples, Style name Hotel Color Black, are pillowcases. The pillowcases are made from a 100 percent cotton sateen woven fabric. The fabric is not printed or napped. The open end of the standard size pillowcases has a 5-inch wide faced hem. The facing is made up from 3 or 5 strips of contrasting color fabrics that have been sewn together. The pillowcases do not contain any embroidery, lace, braid, edging, trimming, piping or appliqué work. The applicable subheading for both pillowcases will be 6302.31.9010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: other bed linen: of cotton: other: not napped… pillowcases, other than bolster cases. The duty rate will be 6.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
