McLafferty Grunfeld, Desiderio, Lebowitz, Silverman & Klestadt 399 Park Avenue 25th Floor New York, N.Y. 10022 RE: The tariff classification of a tote bag from China Dear Ms. Mc Lafferty: In your letter dated December 18, 2008 you requested a tariff classification ruling on behalf of BBC International. The sample which you submitted is being returned as requested. Style 39998 is a tote bag constructed with an outer surface of 100% nylon textile material. It is intended to provide the useful functions of storage, protection, organization and portability to personal effects during travel. The main compartment is unlined with no additional features. The bag has double carrying handles, and an open top with a snap closure. It measures approximately 16.5” (W) x 12” (H). The applicable subheading for the tote bag will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 17.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
