Dear Ms. Sankey: In your letter dated December 2, 2008, you requested a tariff classification ruling. Photographs were provided of arches that will be mounted to the outside of McDonald’s restaurants. The arches are composed of fiberglass reinforced plastics, and will be imported in two sizes: 10-foot arches and 18-foot arches. The arches will be imported with steel mounting plates on the inside so that they can be mounted to the outside of a building. The legs that they are mounted to are made in the United States and will not be imported with the arches. The arches do not have any lighting or electrical features. The applicable subheading for the arches will be 3926.90.9980, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics, other. The general rate of duty will be 5.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
