Dear Ms. Chan: In your letter dated November 6, 2008 you requested a classification ruling on behalf of Jointak USA Inc. Your sample is being retained by this office for our files. Your sample, style 9268S3, is a woman’s “Forever 21” label pull-on strapless dress constructed from 100% polyester knitted fabric. The lined garment extends to the mid-thigh and features, a gathering at the crossover padded bust area, and an elasticized balloon bottom. You have indicated that the size medium sample is equivalent to a size 7/9. The applicable subheading for the dress will be 6104.43.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts ( other than swimwear ), knitted or crocheted: dresses: of synthetic fibers: other: women’s. The duty rate will be 16% ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
