Dear Ms. Yang: In your letter dated October 30, 2008 you requested a classification ruling. As requested, your sample is being returned to you. The submitted sample, style PP 1080242, is a woman’s cut and sewn short sleeve pullover garment with a camisole insert at the bust area simulating a blouse worn over a camisole. The garment is constructed from 100% cotton knitted fabric. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The front panel camisole insert forms the straight front neckline of the garment. The outer front panel features a scoop neckline with four buttons, two of which are non-functional. The garment features short hemmed sleeves, a drawstring tie below the bust on the front panel, and a hemmed bottom. The applicable subheading for the pullover will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s or girls’: other. The duty rate will be 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
