The submitted sample, identified as “Purple Guitar,” is a cushion. The outer shell is made from 100 percent polyester knit fabric. It is filled with foam. The item is shaped to resemble a guitar. It measures approximately 23 x 10.5 inches and is 2.25 inches in thickness. Although it presents a decorative appearance, this item is a functioning cushion. The body portion is sufficient in size and stuffing to be capable of providing support. The applicable subheading for the cushion will be 9404.90.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides mattress supports; articles of bedding and similar furnishing (for example, mattresses, quilts, eiderdowns, cushions, pouffes and pillows) fitted with any material or of cellular rubber or plastics, whether or not covered: other: pillows, cushions and similar furnishings: other. The duty rate will be 6 percent ad valorem. Duty rates are provided for your convenience and are subject to change. Subheading 9404.90.2000, HTSUS is not assigned a textile category designation. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
