Dear Ms. Stanczak: In your letter dated September 18, 2008, you requested a classification ruling. The submitted sample, Style #HCO302, is a woman’s upper body garment referred to as a “shrug”. The garment is constructed from 100% cotton knit fabric and features long sleeves, a full front opening with no means of closure, and a back that extends approximately 14 inches in length. The garment has shoulder coverage and essentially no front coverage. We are returning your sample as you requested. The applicable subheading for Style HCO302 will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted of cotton, Other: Women’s or girls’. The rate of duty will be 10.8% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The shrug, Style HCO302, falls within textile category 359. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
