Lauderdale, FL 33301 RE: The tariff classification of novelty gift bags from China Dear Mr. Crago: In your letter dated September 11, 2008 you requested a classification ruling. The samples which you submitted are being returned as requested. Style A076HA01338 is comprised of three novelty gift bags with different designs embroidered on the front exterior. Each bag is constructed with an outer surface of 100% polyester textile material. The bags are designed to provide storage, portability, organization, and protection to its contents. The bags have unlined main compartments with no additional features, open tops and double carrying handles. They measure approximately 6.25” (W) x 8” (H) x 2.25” (D). The applicable subheading for style A076HA01338 will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other containers and cases, other, other, with outer surface of textile materials, of man-made fibers. The rate of duty will be 17.6% ad valorem. Duty rates are provided for your convenience and are subject to change.
