Broad Street Philadelphia, PA 19112 RE: The tariff classification of cotton tote bag from India Dear Ms. Root: In your letter dated August 15, 2008 on behalf of Urban Outfitters, Inc., you requested a classification ruling. Style Urbn001 is a tote bag constructed with an outer surface of 100% cotton textile material. The bag is designed to provide storage, organization, protection and portability to personal effects during travel. The interior of the bag is unlined and consists of a single compartment with a hanging open pocket on the sidewall. There is a coin purse attached to the bag by a metal chain with a carabineer. The coin purse has a zippered top and measures approximately 2” in diameter. The front exterior of the bag has three decorative textile swatches affixed to the bag by means of safety pins. The tote bag has an open top and double carrying handles. It measures approximately 15” (W) x 16” (H). The applicable subheading for the tote bag will be 4202.92.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change. Importations of this product may be subject to the provisions of Section 133 of the Customs Regulations if they copy or simulate a registered trademark, trade name or copyright recorded with U.S. Customs and Border Protection. If you are an authorized importer of the product we recommend notifying your local Customs office prior to importation. HTSUS 4202.92.1500 falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
