N035741 August 28, 2008 CLA-2-73:OT:RR:NC:N1:118 CATEGORY: Classification TARIFF NO.: 7318.14.5080 Mr. Bernard D. Liberati Morris Friedman & Co. P.O. Box 1550 1153 Marlkress Road Cherry Hill, NJ 08003 RE: The tariff classification of metal screws from Germany. Dear Mr. Liberati: In your letter dated August 8, 2008, on behalf of Globe International Corp., you requested a tariff classification ruling. You have described the submitted sample as Sheet Metal Screws. This metal screw measures ¼ – 20 x 5/8”. It has an indent hex washer head with a gimlet point. The applicable subheading for the metal screws will be 7318.14.5080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: threaded articles: self-tapping screws: having shanks or threads with a diameter of 6 mm or more: other. The duty rate will be 8.6% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Consideration was given to classifying this item as a machine screw or other screw, found under the subheading for other screws and bolts, however, it was deemed inappropriate. Self-tapping screws more specifically define this fastener. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
