Box 1199 Williston, VT 05495 RE: The tariff classification of a bird feeder from China Dear Ms. Ramsey: In your letter dated July 15, 2008, you requested a tariff classification ruling. A sample was submitted for our review. The merchandise is described as a Bird Feeder with Protective Cage. It is available as a single unit (item number 22640) or as a set of 2 bird feeders (item number 22645). The bird feeder has a center cylindrical chamber to hold the birdseed. The seed chamber is surrounded by a wire cage to keep squirrels and large birds away. You state in your letter that the bird feeder is made of enameled iron. The applicable subheading for the bird feeder will be 7323.94.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for table, kitchen or other household articles and parts thereof, of iron or steel…of iron (other than cast iron) or steel, enameled, other. The rate of duty will be 2.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
