McCullough Vandegrift Forwarding Company Inc. 9317 Cheshire Road Sunbury, OH 43074 RE: The tariff classification of a woman’s undergarment from China. Dear Mr. McCullough: In your letter dated July 15, 2008, you requested a classification ruling on behalf of your client, H&M Hennes & Mauritz LP. The submitted sample will be returned. The submitted sample, style 449140 1336, is a woman’s hipster styled panty brief with four detachable hanging garters. The undergarment features eight panels which are constructed of 100% polyester woven fabric and four panels which are constructed of 88% nylon and 12% spandex knitted net fabric. The undergarment also features a fabric covered elasticized top, hemmed high cut leg openings, three decorative fabric covered buttons at the center front and a lined crotch panel. The applicable subheading for style 449140 1336 will be 6212.90.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: other…of man-made fibers or man-made fibers and rubber or plastics. The duty rate will be 6.6% ad valorem. Duty rates are provided for your convenience and are subject to change.
