Dear Mr. Salvato: In your letter dated July 2, 2008, you requested a tariff classification ruling on behalf of Loyaltex Fashion Inc. As requested, your sample will be returned. Style / part # 5K560 is a men’s pullover garment constructed from 80% cotton, 20% polyester, finely knit, sueded fabric that is napped on the inside surface. The garment has a lined, self-fabric hood with a drawstring; a partial front opening with a zippered closure; long sleeves with rib knit cuffs; 100% cotton, 1x1 rib knit side panel inserts; a pouch pocket below the waist; and a rib knit bottom. The applicable subheading for Style / part # 5K560 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men's or boys': other. The rate of duty is 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change.
