Dear Rizner: In your letter dated June 12, 2008, you requested a classification ruling. The submitted sample, Style #1260, is a pair of women’s low rise shorts constructed from 100% cotton knit fabric. The pull-on shorts feature a wide flat elasticized waistband with a drawstring and short hemmed leg openings. You state that the garment will be imported in women’s sizes S-2XL. You also state that the shorts will be imported in girls’ sizes S-L under Style #1261. Your sample is being returned as requested. The applicable subheading for the women’s shorts, Style 1260, will be 6104.62.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ trousers, bib and brace overalls, breeches and shorts (other than swimwear) knitted or crocheted, trousers, bib and brace overalls, breeches and shorts, of cotton, other, shorts, women’s. The rate of duty will be 14.9% ad valorem. The applicable subheading for the girls’ shorts, Style 1261, will be 6104.62.2060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ trousers, bib and brace overalls, breeches and shorts (other than swimwear) knitted or crocheted, trousers, bib and brace overalls, breeches and shorts, of cotton, other, shorts, girls’, other. The rate of duty will be 14.9% ad valorem. Duty rates are provided for your convenience and are subject to change. The women’s shorts, Style 1260 and the girls’ shorts, Style 1261 fall within textile category 348. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
