Dear Ms. McLafferty: In your letter dated June 18, 2008, on behalf of In Mocean Group LLC, you requested a classification ruling. As requested, the sample will be returned to you. The submitted sample, Style TX230618, is a woman’s two-piece bikini-style swimsuit constructed of knit 82% nylon/8% spandex fabric. The top has two lined triangular cups with removable padding, ties at the neck and has a clasp at the back, and features a decorative string between the cups. The bottom is lined and features decorative strings at the sides. The applicable subheading for Style TX230618 will be 6112.41.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Track suits, ski-suits and swimwear, knitted or crocheted: Women’s or girls’ swimwear: Of synthetic fibers, Of fabric containing by weight 5 percent or more elastomeric yarn or rubber thread: Women’s.” The rate of duty will be 24.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
