Eisen Baker & McKenzie 1114 Avenue of the Americas New York, New York 10036 RE: The tariff classification of a comforter from China Dear Mr. Eisen: In your letter dated June 11, 2008 you requested a classification ruling on behalf of PEM America, Inc. You will be importing a comforter. A sample of a pillow sham was submitted to represent the comforter. The outer shell is made from a 100 percent cotton woven flock printed fabric. It will be stuffed with polyester filler. The edges are finished with an approximately 6 millimeter wide flocked piping cord. You state that the piping in the actual product will not exceed 6.35 millimeter. The applicable subheading for the comforter will be 9404.90.8020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for mattress supports; articles of bedding and similar furnishing (for example, mattresses, quilts, eiderdowns, cushions, pouffes and pillows) fitted with any material or of cellular rubber or plastics, whether or not covered: other: other: of cotton, not containing any embroidery, lace, braid, edging, trimming, piping exceeding 6.35 mm or applique work… quilts, eiderdowns, comforters and similar articles. The rate of duty will be 4.4 percent ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
