LLC 2060 North Kolmar Ave. Chicago, IL 60639-3483 RE: The tariff classification of gloves from China. Dear Mr. Pump: In your letter dated June 4, 2008, you requested a classification ruling. The samples submitted will be returned. You state in your letter that the garment contains bamboo. For purposes of this ruling, we are assuming that what you call bamboo is actually an artificial fiber, which is derived from bamboo. Style G118T is a string-knit glove with a PVC dot coating covering the palm side from fingertips to wrist. You have indicated that the PVC coating does not exceed 50% of the weight of the glove. The glove features a ribbed knit wrist with an overlock stitch finish at the bottom cuff. You state that the fiber content of the glove is 100% bamboo. The essential character of the glove is imparted by the coated fabric palm side. Style ROC40T is a string-knit glove with a rubber (nitrile) coating, which covers the entire palm and overlaps the backside fingertips and sides of the wearer’s hands and fingers. You have indicated that the weight of the coating is greater than 50% of the weight of the glove. The glove features a ribbed knit wrist with an overlock stitch finish at the bottom cuff. You state that the fiber content of the glove is 100% bamboo. The applicable subheading for style G118T will be 6116.10.5520, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: Other: Without fourchettes: Other: Containing 50 percent or more by weight of cotton, man-made fibers or other textile fibers, or any combination thereof . . . Subject to man-made fiber restraints. The duty rate will be 13.2% ad valorem. The applicable subheading for style ROC40T will be 6116.10.6500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other. The duty rate will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change.
