Everett Street Appleton, WI 54914 RE: The tariff classification of a spunbonded nonwoven material, for use in the manufacture of packaging for the medical sterilization field, from an unspecified country. Dear Ms. Kent: In your letter dated June 4, 2008, you requested a tariff classification ruling. You seek classification advice for a material identified as product code 211149. Several representative samples were submitted. These samples consist of individual pieces cut to shape and size with rounded edges. These pieces are composed of Tyvek ® material. That is, they are made of a spunbonded nonwoven material (filament), which in this case, contains an adhesive coating applied to one side. You write, that depending upon the customer’s requirements, this material may be imported as roll goods or cut to shape and size as depicted by the instant samples. Ultimately, this material will be made into lids for plastic trays in which sterilized medical instruments will be placed. The coating on the material will act as a barrier to contamination while also ensuring a strong seal to the trays. Additionally, the lid will also provide a place to print pertinent data regarding the instruments in the tray. The applicable subheading for the material, if imported as roll goods, will be 5603.13.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for nonwovens whether or not impregnated, coated, covered or laminated, of man-made filaments, weighing more than 70 g/m² but not more than 150 g/m². The duty rate will be Free. The applicable subheading for the product if imported as per the submitted samples in cut to size pieces with rounded edges will be 6307.90.9889, HTSUS, which provides for other made up textile articles, … other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change.
