Dear Mr. Rizner: In your letter dated April 29, 2008, you requested a tariff classification ruling. As requested, your sample will be returned. Style 5260 “Heavyweight Color Block Zip Front Hooded Sweatshirt” is a men’s jacket constructed from 50% cotton, 50% polyester, finely knit fabric that is napped on the inside surface. The garment has a lined, self-fabric hood with a drawstring; a full front opening with a zippered closure; long sleeves with rib knit cuffs; contrasting color overlaid strips on each sleeve; pouch pockets below the waist; and a rib knit bottom. Style 5260 will be imported in Men’s sizes S - 3XL. The same garment will be imported in Boys’ sizes S – L as Style 5261. At the time of entry, Customs may verify the actual fiber content of Styles 5260 and 5261. If the fiber content differs from that indicated in your letter, the tariff classification may change from the information indicated below. Following note 2 (A) of section XI, if no textile material predominates by weight, the garment is classifiable in the heading that occurs last in numerical order among those which equally merit consideration. Consequently, the applicable subheading for Style 5260 will be 6101.30.2010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers, and similar articles, knitted or crocheted: other than those of heading 6103: of man-made fibers: other: other: men’s. The rate of duty is 28.2% ad valorem. The applicable subheading for Style 5261 will be 6101.30.2020, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers, and similar articles, knitted or crocheted: other than those of heading 6103: of man-made fibers: other: other: boys’. The rate of duty is 28.2% ad valorem. Styles 5260 and 5261 fall within textile category designation 634. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
