Broad Street Philadelphia, PA 19112-1404 RE: The tariff classification of woman’s pullover from Hong Kong. Dear Mr. Hoffacker: In your letter dated May 1, 2008 you requested a classification ruling on behalf of your client Combined Interest Inc. As requested, your sample is being returned to you. The submitted sample, style 54977S, is a woman’s pullover that is constructed from 70% cotton and 30% nylon 4x4 ribbed knit fabric. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment features a lace insert that extends the edge of the v-shaped neckline, long sleeves, and a straight garment bottom. No component pieces were submitted, however, a Chapter 61 Statistical Note 6 knit to shape review was based on the completed garment. The lace insert is a component that is not knit to shape. Style 54977S does not qualify as a Chapter 61 Statistical Note 6 knit to shape garment. The applicable subheading for the pullover will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s or girls’: other. The duty rate will be 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
