Crago Atico International USA, Inc. 501 South Andrews Avenue Fort Lauderdale, FL 33301 RE: The tariff classification of a plate from India Dear Mr. Crago: In your letter dated April 29, 2008, you requested a tariff classification ruling. The merchandise is identified as a Metal Leaf Candle Plate (item number A029CA01436). It is a leaf-shaped plate made of iron with a shiny nickel finish. The plate measures approximately 8.5 inches in length by 4 inches in width. You describe the article as a candle plate in your letter. In our opinion, the plate is neither principally used nor specially dedicated as a candle holder. We consider it to be a general purpose household article having other possible uses. The applicable subheading for the plate will be 7323.99.9060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for table, kitchen or other household articles and parts thereof, of iron or steel…other, not coated or plated with precious metal, other, other, other. The duty rate will be 3.4 percent ad valorem. Duty rates are provided for your convenience and are subject to change. Articles classifiable under subheading 7323.99.9060, HTSUS, which are products of India, may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.
