Dear Mr. Mutto: In your letter dated April 19, 2008, on behalf of Standard Fiber LLC, you requested a tariff classification ruling. The instant samples, which you describe as “pillow sheets”, consist of spunbonded nonwoven fabrics. One is composed of 100 percent polyester man-made fibers while the other is of 100% polypropylene man-made fibers. The sheets are rectangular in configuration and measure 18" x 24". These sheets are designed to be placed on a bed pillow to protect the underlying material. The applicable subheading for the sheets, which both weigh 40 g/m², will be 5603.12.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for nonwovens, whether or not impregnated, coated, covered or laminated, of man-made filaments, weighing more than 25 g/m², but not more than 70 g/m². The duty rate is Free. Duty rates are provided for your convenience and are subject to change.
